09:35:00 Issuance of Citations

PURPOSE

Establish policy relative to the issuance of Campus and State citations for traffic and misdemeanor violations by Walters State police officers.

POLICY

The commitment of the Campus Police Department to campus safety includes monitoring traffic and parking.  As per institutional policy, the criminal and misdemeanor laws as well as the traffic laws of the State of Tennessee, apply to all campus properties and to all persons who attend, work or visit and/or operate a motor vehicle on college property. Walters State Community College encourages students, employees and visitors to be aware of their responsibility for their own safety and the safety of others when on campus, and their responsibility to abide by the laws of the State of Tennessee as well as college rules and regulations.  

CAMPUS REGULATIONS - ALL CAMPUSES

  • Students shall not park in areas designated for staff, faculty, visitors, disabled, no parking zones, or 24 hour reserved spaces.
  • Any vehicle (student or employee) parked in areas designated for individuals with disabilities must display a valid state disability parking permit and a WSCC disability hang tag.
  • State issued disability permits must be registered to the driver of the vehicle. Disability permits registered to a disabled family member may not be used for disability parking unless that family member is occupying the vehicle when parked.
  • All disabled spaces on all campuses are open to all students with disabilities regardless of location in a student or faculty lot. Should all disability parking in a parking area be filled, students or employees may utilize a regular space in that lot. However, a valid state disability permit and WSCC disabled permit must be displayed.

CAMPUS REGULATIONS SPECIFIC TO THE MORRISTOWN CAMPUS

  • Faculty/staff shall not park in reserved spaces not assigned to them.
  • The following parking areas are designated student parking on the Morristown campus: D, E, P, Q, R.
  • The following parking areas are designated faculty/staff/visitor parking on the Morristown Campus: A, B, C, F, G, H, I, J, K, L.
  • After 5:30 p.m. on the Morristown campus the following faculty/staff/visitor parking areas are open to student parking: A, B, G, H, J, L.
  • The following parking areas on the Morristown campus are never open to student parking: C, F, I, K.
  • On the Morristown campus, all large vehicles requiring multiple parking spaces and/or vehicles with attached trailers or other extensions must park in student lot P at all times.

CAMPUS REGULATIONS SPECIFIC TO THE NISWONGER CAMPUS

  • Faculty/staff/visitor parking is indicated by blue or labeled curbs.
  • Student parking is available in the following lots: College Street Parking Lot, Main Street Parking Lot, Spencer Street Parking Lot, Depot Street Parking Lot, Tusculum Blvd. Parking Lot

CAMPUS REGULATIONS SPECIFIC TO THE CLAIBORNE COUNTY CAMPUS

  • Faculty/staff/visitor parking is located in lots: A, B, C, and D.
  • Student parking is located in Lots B and D.
  • Parking area for student pick up is in lot A and B.

STATE LAW VIOLATIONS

The State of Tennessee violations below will be enforced on all campuses. Tennessee Code Annotated (TCA) regulations will be indicated on the Tennessee Multiple Offense Citation. 

  • Reckless driving
  • Improper passing
  • Driver’s license violation
  • Muffler law
  • Seatbelt law
  • Traffic control device/signal
  • Following too close
  • Open container
  • Window tint
  • Child restraint device
  • Registration violation
  • Light law
  • Financial responsibility
  • Pedestrian rights of way
  • Misdemeanor violations in lieu of arrest

ENFORCEMENT

  • All criminal, misdemeanor and State of Tennessee Motor Vehicle Laws are applicable on all campuses 24 hours a day.
  • Campus police officers or sub-contracted municipal police on all campuses are responsible for enforcement of state and local laws as well as college regulations 24 hours a day.
  • Officers should issue a state citation in lieu of a misdemeanor arrest where applicable and/or for traffic violations not covered by existing campus regulations and according to state law.
  • State citations should not be used in lieu of criminal arrest.
  • Speed limit on all campus streets is 20 mph unless otherwise posted.Speed limit in all campus parking lots is 10 mph.Speed limit on campus are radar enforced and will be enforced with a campus citation unless circumstances require otherwise.
  • Speed limit on city streets within a campus are as posted and enforceable by use of a state citation.

 

FINES

Campus Violations:

  • The fine for parking and registration violations is $15.
  • The fine for parking in areas designated as “Disabled” is $200. (TCA 55-21-108)
  • The fine for a moving vehicle violation is $15.
  • Fines should be paid promptly during the current semester to avoid penalties.
  • Fines may be paid in the Business or Cashier’s Office of each campus between 8 a.m. and 4 p.m., Monday-Friday.

 

State Violations:

  • All fines associated with state citations will follow the fines of the jurisdiction where the campus is located and/or will be decided by the court and per Tennessee Code Annotated.
