06:25:00 Overtime/Compensatory Time

Purpose

The purpose of this policy is to establish rules and guidance for the earning and use of compensatory time/overtime.


Policy

I. Work Schedule

The College’s regular work day is the period from 8:00 a.m. to  5:30 p.m. The regular work week is 37.5 hours worked between the hours of 12:01 a.m. Saturday through midnight Friday. Work schedules of non-exempt employees (clerical and support staff) that vary from the above on a regular basis require approval of the president.

II. Prior Approval

Approval for clerical and support staff to work in excess of 37.5 hours per week is not a normal practice of the college. For extenuating circumstances, however, a supervisor may request that an employee work overtime after having received prior approval from the president. In such cases, WSCC form Request for Compensatory Time or Overtime is to be used to document the request and approval. Some Campus Police and facilities management personnel have regular work hours that are different from the 8:00 a.m. to 5:30 p.m. schedule noted above.

III. Compensatory Time-Off

Compensatory time off may be authorized by the president in lieu of hourly wage payments for any hours worked by non-exempt employees in excess of 37.5 hours per week. All hours worked in excess of 37.5 hours up to 40 in a given workweek may be taken as compensatory time at a straight-time rate at any time during the pay period in which they were earned. If not taken during the pay period, the hours must be paid at the straight-time rate.

All hours worked in excess of 40 in a given workweek may be taken as compensatory time off at time and one-half during any subsequent workweek in the pay period in which they were earned when possible. Otherwise the compensatory time should be taken as soon as practical and prior to any year-end on June 30th. If an individual has earned comp time, it is expected that this comp time will be used prior to requesting annual leave. Any recorded compensatory time at June 30th will be paid, but should be rare and must have approval.

IV. Overtime Payment

Overtime payment may be authorized by the president for any hours worked by non-exempt employees in excess of 37.5 hours per week. Hours worked in excess of 37.5 and equal to or less than 40 in a workweek are compensated at the straight-time rate and those in excess of 40 at the time and one-half rate.

V. Exempt Employees

Overtime and compensatory time procedures are not applicable to employees who are exempt from the Fair Labor Standards Act (administrative, faculty, and professional non-faculty employees).
